These terms of service cover your use and access to Thought Process Software LLC's (variously referred to in these terms as "our", "us", "we") services. The Privacy Policy below explains how we collect and use your information and our Acceptable Use Policy below outlines your responsibilities when using our services. By using our services, you are agreeing to abide by these Terms, our Privacy Policy, and Acceptable Use Policy.

  1. Your account: You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Please notify us promptly at the contact address below if you believe your account has been compromised.
  2. Your content: You retain full ownership of everything you upload or create with our services. We claim no ownership over your content. You grant us only the limited rights needed to operate the services on your behalf — that is, to store, process, index, and display your content to you and to the collaborators you choose to share it with.
  3. Payments: Paid plans are billed through our payment processor, Stripe. Fees are as posted at the time of purchase. You may cancel a paid plan at any time; cancellation takes effect at the end of the current billing period.
  4. Termination: You are free to stop using our services and to delete your account at any time. We reserve the right to suspend or terminate access to our services for violations of these Terms or the Acceptable Use Policy below.
  5. Disclaimers and limitation of liability: To the fullest extent permitted by law, we make no warranties and provide our software "as is", without warranty of any kind, whether express or implied. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the services, and our total liability for any claim relating to the services is limited to the amounts you paid us in the twelve months preceding the claim.
  6. Governing law: These terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising from these terms or your use of the services will be resolved in the state or federal courts located in California.

Privacy Policy

Below is a description of what data we collect, and how we handle and use it.

  1. What we collect: When you use our services, we collect the contact information you provide (i.e. your email address and any collaborators' email addresses), and the text material (i.e. website text, PDFs, notes, etc.) you upload for use with our software services. We also collect file metadata (names of files and the times files were uploaded). Like most online services, our servers also keep standard technical logs (such as IP addresses and request timestamps) which we use only for security, debugging, and keeping the services reliable.
  2. Payment information: If you purchase a paid plan, your payment is handled by our payment processor, Stripe. We never see or store your full card details; we retain only what is needed to manage your subscription (such as your plan and billing status).
  3. Privacy: We do not sell any of your data or usage patterns, or any aggregated information derived therefrom, to any third parties. We do not use your data to train any machine learning models, and we do not permit our service providers to do so.
  4. How your data is used: The files and text data that you upload are stored and processed in such a way that make them searchable for your use. You can also elect to share data of your choosing with people whom you specify, through the collaborative feature of our services. In such cases, we store the account information of the people you share with in order to make the data accessible to those parties.
  5. AI processing: To make your material searchable, we generate embeddings (numerical representations of text) using AWS-provided models running on Amazon Bedrock, within the same AWS cloud environment where your data is stored. If — and only if — you choose to enable it, certain features can also use third party model providers (for example, those offered by Anthropic or OpenAI), which we likewise access through Amazon Bedrock; this is off by default. In all cases, under AWS's Bedrock terms, your content is not retained by the model providers and is not used to train or improve any models.
  6. Service providers: We rely on a small number of service providers to run our services: Amazon Web Services (cloud hosting, storage, authentication, and the AI processing described above) and Stripe (payment processing). These providers process your data only on our behalf and only to provide our services to you.
  7. Security: Your data is encrypted in transit (TLS/HTTPS) and at rest. We use industry-standard authentication services (AWS Cognito), access controls that limit data access to what is necessary to operate the services, and standard cloud-computing (AWS) security practices to protect your data. No method of transmission or storage is perfectly secure, but if we learn of a breach affecting your data, we will notify you as required by applicable law.
  8. Device Information and Cookies: We do not collect any information about your devices beyond the standard technical logs described above. The only cookies we use are first-party cookies for authentication purposes (i.e., verifying that you are logged in during a session of using our services). We do not use advertising cookies, third-party tracking cookies, or third-party analytics.
  9. Data retention and deletion: We retain your data for as long as your account is active. You can delete individual files, notes, and collections at any time, and you can delete your account entirely from your account settings. When you delete your account, your content is deleted from our active systems, after which it may persist for a limited time in routine backups before being purged.
  10. Your rights: You may access, correct, export, or delete your personal data at any time, either directly through the services or by contacting us at the address below. Depending on where you live, you may have additional rights under applicable privacy laws (such as the GDPR or CCPA), and we will honor requests to exercise them.
  11. Children: Our services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us and we will delete it.
  12. Legal disclosures: We may disclose your information if we believe in good faith that doing so is required by law, such as in response to a valid subpoena, court order, or other legal process, or to protect the safety, rights, or property of our users or the public.

Acceptable Use

Below is a description of what constitutes acceptable usage of our services. By using our services, you agree not to try to do any of the following with our services:

  1. Attempt to breach any security or authentication measures, or otherwise interfere with or hamper the operation of our services in any way.
  2. Probe, scan, or test the vulnerability of our systems, or access or attempt to access another user's account or data without authorization.
  3. Use automated means (such as bots or scrapers) to access the services in a manner that sends more requests than a person could reasonably produce using a conventional browser, or otherwise circumvent any usage limits.
  4. Store, distribute, or transmit any viruses, malware, or other harmful code, or use the services to send spam, phishing messages, or other unsolicited communications.
  5. Reverse engineer, decompile, or resell the services, or unlawfully redistribute any of our intellectual property.
  6. Impersonate another person or misrepresent your affiliation with any person or entity.
  7. Use our services to store any data that you do not have a legal right to have in your possession, including personal information about others collected or held unlawfully.
  8. Store or distribute any material that violates the law, including, but not limited to, storing or distributing material that is fraudulent, defamatory, or in violation of the intellectual property rights of others.
  9. Store or share anything that contains or promotes extreme acts of violence or terrorist activity.
  10. Store or share anything that constitutes child sexually exploitative material (including material which may not be illegal child sexual abuse material but which nonetheless sexually exploits or promotes the sexual exploitation of minors), unlawful pornography, or is otherwise indecent.

We reserve the right to revoke a user's access to our services in the event that any of the terms of Acceptable Use just described are violated. You are free to stop using our services at any time. These terms and policies may change, so please check back periodically; if we make material changes, we will update the dates above and take reasonable steps to bring the changes to your attention.
